Wrongful Death

Elements of a Wrongful Death Lawsuit

In order to bring a successful wrongful death cause of action, the following elements must be present:

  • The death of a person;
  • Caused by another's wrongful act, negligence or fault;
  • The survival of family members who are suffering monetary injury as a result of the death, and;
  • The appointment of a personal representative for the decedent's estate.

A wrongful death claim may arise out of a number of circumstances, such as medical malpractice, an automobile accident or as a result of a dangerous work condition.

Damages in a Wrongful Death Lawsuit

Michigan's wrongful death statute provides that fair and equitable damages may be awarded.  Such damages include compensation for medical, hospital, funeral and burial expenses, pain and suffering that the deceased person endured, and loss of financial support and companionship to the family.

While the damages received do not replace the person lost, damages received can allow for a proper burial and continuing support for the family members left behind.
